​WHAT YOU CAN DO:

1.) You CAN sell the content you create Only within the Second Life grid using the (animations, scripts, textures) henceforth referred to as 'items' supplied to you in your purchase from Penelope Engel (SL Avatar Name: pcruise78.resident) of Avatar Animations™ Inc.

 

WHAT YOU CAN NOT DO:

1.) You cannot share, sell, or distribute these items in or outside of Second Life™ for free or for any form of profit real or virtual, in any other form tangible or otherwise.

2.) You cannot share these items for any reason.

3.) You cannot distribute into other virtual worlds or copy to CD / DVD or other digital format for the purpose of distribution for free or for any form of profit real or virtual, this includes making a back-up to your hard drive in order to upload to a different or separate account not authorized as a licensee under this agreement.

 

Detailed License Information follows:

Avatar Animations™ and the person being offered the license for use of our items, (“You”) being the person purchasing the license to use our items, will be henceforth referred to as ‘you’, ‘yourself’, ‘customer’, ‘licensee’ for the sake of this License.

 

By purchasing and using one of our items you are agreeing to the following terms in this ‘End User License Agreement’ (EULA) and do herein agree to be legally bound to this EULA. You are purchasing the right (or license) to use the supplied 'Avatar Animations™' items in accordance with this EULA. You do not nor will you ever “own” the intellectual property of these items . Your payment is for the License to use the supplied items ; it does not make them yours to sell. Under DMCA and International Intellectual Property Laws, only the original artist can claim ownership of the items . For example when purchasing a Blu-Ray / DVD / or CD, it allows you to ability enjoy the music / movie / content supplied. However you do not own the actually content in the sense that you may share/distribute/sell/give away copies of it with other people regardless of financial gain.

 

‘You’ the licensee may use the supplied 'Avatar Animations™' items purchased for any creation within the Second Life grid only, for personal and/or commercial content creation. In short you, the licensee are allowed to sell anything you create with the supplied 'Avatar Animations™' items inside Second Life Only, with the exception of adding 1 texture to 1 prim and selling that prim as "content” or giving it away freely with full permission access to the items. The licensee’s content creation MUST be made up of time, skill and multiple prims (with exception to clothing & skin template designer packages) such as prefab buildings, furniture and sculpted prims, and May never be sold nor given away freely (statement of freely means for less than 101 L$)

 

The licensee may save to one computer only, one set of back-up copies of the supplied 'Avatar Animations™' items to modify in artistic program(s) for use on/as content created only within the Second Life grid. You as the licensed user of these items are responsible for their security.

 

The licensee may apply for permission to add to prefabricated buildings ( or SecondLife™ content creation made of prims ) copies of 'Avatar Animations™' items used on the basis that the Next Owner: Transfer [Sell/Give] Permission must be un-ticked so that your customers may not re-sell these items on anything BUT the content they purchased from 'You' the licensee. There is no charge for this extended license but the license MUST be applied for, in order to receive these added permissions, such must be granted this extended license in written verification, before proceeding with such actions.

 

We ‘Avatar Animations™, the Licensor hold a list of content creator’s who wish to include 'Avatar Animations™' items as part of their creations but we need to ensure the licensed 'Avatar Animations™' items are in, and remain in safe hands. Please send a note card in world to Penelope Engel (pcruise78.resident) in order to apply for an extended license (please allow up to 15 business days for a response).

 

Anyone found distributing 'Avatar Animations™' items along with their content creation or as items without written permission will be found in breach of this legally binding agreement, as well as the Second Life EULA, and will face a DMCA take down order including all content created using 'Avatar Animations™' items, as well as Real World Legal Criminal Charges.

 

Licensee cannot share, give, sell or otherwise distribute for free, linden dollars ($L), or any real life currency any 'Avatar Animations™' items. Licensee cannot freely distribute 'Avatar Animations™' files to anyone for any reason what so ever. Anyone found openly sharing 'Avatar Animations™' items / animations / builds etc... in groups or in any other capacity may face DMCA procedures were the item in question will be remove from your inventory, as well as Real Life Criminal Charges.

 

As per Linden Labs Terms of Service, repeated DMCA reports may result in account suspension or personal real world ban from Second Life.

Any report in violation of these terms of reselling items/textures/mesh/sculpts/prim builds/animations/gestures etc... from 'Avatar Animations™' in any form will be dealt with by Linden Labs DMCA department, regardless of circumstances. Linden Labs can and will remove 'Avatar Animations™' copy protected items from your inventory and if items exist on any land rented or owned by you, they will be removed from those locations as well.

If the copyright breach is large or has taken place over a long period of time, the Licenser will consider seeking real world legal action for , fraud, breach of contract, and financial damages.

Licensee cannot save to hard drive to then re-upload to any other account name or grid, for the purposes of use or distribution free or otherwise. Any cases of this will be dealt with in the same manner as detailed above.

 

Licensee cannot save to your hard drive to distribute or otherwise share on outside Websites, copy to CD/DVD or any other form of distribution free or otherwise. Any reports of this will be pursued pursuant to the Digital Millennium Copyright Act (DMCA), the EU Copyright Directive or EUCD and any other applicable laws and treaties that may govern the licensee.

 

Licensee herein agrees to have all Legal Proceedings handled by the Local Authorities of the Content Creators Local Jurisdiction. [United States – North Carolina – Alamance County District Court]

In order to protect our copyright holdings, ANY violation of our company End User License Agreement which you received with your purchase, as well as agreed to be legally bound to when using our product, even if you failed to read it, will be met with DMCA take down and potential legal actions.

 

Violators of this agreement will be prosecuted and may risk action taken against them by Avatar Animations™ LLC and Linden Lab.

 

Note: If you do not accept or agree with these terms, you may not use our products for any reason, Note failure to read these terms does not exempt you from them. By using our products, you agree to be bound by these terms, ignorance of the law is not a viable defense.
